1. About these terms

This website is operated by Demir Loans Pty Ltd (ABN 49 698 798 088), trading as demir.loans ("we", "us", "our"). We are a credit representative (Credit Representative Number 580174) of LMG Broker Services Pty Ltd ACN 632 405 504, Australian Credit Licence 517192. These terms govern your use of this website. By continuing to use it, you accept them. If you don't agree with them, please don't use the site.

The site is intended for people in Australia and may not comply with the laws of other countries. We may update these terms from time to time; the "last updated" date above tells you when they last changed.

Sections 1 to 7 are the terms on which you use this site. Sections 8 to 16 are our website policy, which explains how your information is treated as you access and interact with this website. How we handle personal information more generally, including information you give us once we start working together, is set out in our privacy policy.

2. Using this site

You're responsible for your own use of this website. You agree not to use it to break any law or infringe anyone's rights, not to transmit viruses or harmful code through it, and not to interfere with its security or operation or access it in unauthorised ways.

3. General information only

Everything on this website is general information provided for your interest and convenience. It doesn't take your objectives, financial situation or needs into account, and it isn't credit advice or an offer of credit. No interest rates are quoted on this website. While we take reasonable care to keep the content accurate and current, we can't guarantee it is complete or up to date; things change without notice. Before acting on anything you read here, talk to us so we can consider your actual circumstances.

4. No financial products supplied on this site

This website doesn't supply loans or financial products directly; it's how you find and contact us. If you send us your details, we'll use them to get in touch and, where you ask us to, to provide credit assistance. Any loan you apply for is provided by the relevant lender on that lender's terms.

5. Availability & changes

We don't promise the website will always be available or error-free, and we may change, suspend or remove any part of it at any time.

6. Liability

To the extent the law allows, we exclude liability for loss or damage (including indirect or consequential loss) arising from your use of, or inability to use, this website or its content. Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that can't be excluded; where our liability can't be excluded but can be limited, it is limited to re-supplying the relevant service or paying the cost of having it re-supplied.

7. Intellectual property

The content on this website, including the demir.loans name, logo and text, belongs to us or our licensors. You may view and print pages for your own personal use, but you may not otherwise reproduce, adapt or distribute any part of the site without our written permission. Third-party names and logos remain the property of their owners.

8. Information we collect through this website

We may collect personal information from you directly, or through your use of our services. We only collect personal information that is reasonably necessary for, or directly related to, our functions or activities.

If you fill in the enquiry form on this site, we collect the details you enter, which are your name, phone number, email address and what you are looking to do. We use those details to contact you about your enquiry. If you book a call, the booking is handled through a Google Calendar appointment page, and the details you enter there go to Google as well as to us.

9. Sensitive information

Sensitive information is information about a person's racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association or trade union, sexual orientation or practices, criminal record, or health information.

We will not ask you to disclose sensitive information through this website. If you choose to provide it anyway, for example in a free-text message, it will also be captured and stored.

10. Cookies

A cookie is a small text file placed on your device by a web server, which can later be retrieved by that server. Cookies are used widely across the web, and you can choose whether and how cookies are accepted by configuring the preferences in your internet browser.

This website does not set any cookies of its own. We do not use cookies to allocate an identifier to your browser, to customise the site for you, or for statistical purposes.

Cookies may still be set by the third-party services embedded in some pages, which are described in section 12. Those cookies are set by those providers under their own policies, not by us.

11. Advertising and tracking

We do not run analytics, advertising or tracking software on this website. There is no analytics platform, no advertising pixel and no web beacon on these pages. We do not track which pages you visit, and we do not build a profile of your browsing.

If that changes, we will update this policy and this page before turning anything on.

12. Third-party content and embedded services

This site loads a small number of third-party services. When your browser loads them, that provider receives your IP address and standard browser information, and may set its own cookies:

The site also contains links to other websites, for example AFCA and LMG. We don't control third-party sites, we aren't responsible for their content, and linking to them doesn't mean we endorse them. Where you reach a third-party site from ours, information about your preferences or information you have provided about yourself may be shared between us and that third party as part of our arrangements with them.

13. IP addresses and server logs

Your IP address identifies your device when you use the internet. Our hosting provider records standard server logs, which include IP addresses, as part of delivering and securing the site. It may be necessary for us to collect your IP address in connection with your interaction with parts of this website.

14. Security of information

The security of your information is important to us. We review developments in security and encryption, but no data transmission over the internet can be guaranteed as totally secure, so information you send through this site is sent at your own risk. Please also take your own precautions against viruses and other interference when using the internet.

We take all reasonable steps to protect the information in our systems from misuse, interference, loss, and unauthorised access, modification or disclosure. Once we are working together, sensitive documents are collected through FileInvite, a secure document portal, rather than by plain email. If we no longer require your information, and we are legally permitted to dispose of it, we take reasonable steps to destroy or de-identify it.

15. Direct marketing

We will not use or disclose sensitive information about you for direct marketing purposes unless you have consented to that use or disclosure. We may use your personal information for direct marketing. If you don't want to receive direct marketing from us, or you want to know the source of the information being used, email ugur@demir.loans and we will respond as soon as practicable, at no charge to you.

16. Disclosure to overseas entities

We do not generally disclose personal information obtained through this website to overseas entities. Some of the third-party services described in section 12, and some of the cloud systems used to store enquiries once we receive them, are operated from outside Australia. Our privacy policy explains how overseas disclosure is handled more fully.

17. Privacy

Any personal information you provide through this website is handled in accordance with our privacy policy, which also explains how to access or correct your information and how to make a privacy complaint. If you have a complaint about anything else, our complaints page sets out the process and the timeframes you can expect.

18. General

If any part of these terms turns out to be invalid or unenforceable, the rest still applies. These terms are governed by the laws of New South Wales, Australia.
